Client Testimonials
Siti Rahimah bt Othman
HR Manager · Petaling Jaya
We engaged Cahaya Firm to review our employee handbook and leave policy after the 2023 Employment Act amendments. The gap analysis was thorough, and the revised documentation was clear and ready to implement. What I appreciated most was that the team explained the regulatory changes in plain terms — not just the document output. The turnaround was faster than expected and the fee was exactly as quoted.

We faced an unfair dismissal claim at the Industrial Court and were unsure how to proceed. The team at Cahaya Firm assessed our position honestly — they told us where we had vulnerabilities, which I found refreshing. Their preparation for the conciliation was thorough, and we reached a settlement we considered fair. The experience gave us a much better understanding of where our HR procedures needed strengthening.

I approached Cahaya Firm when I was offered a new employment contract with a non-compete clause I was concerned about. The review was clear — the lawyer explained which elements were standard, which were unusually broad, and what I might reasonably request to change. I went back to my employer with specific, informed feedback. It was money well spent and removed a significant amount of uncertainty from what was already a stressful transition.

Our company was going through a retrenchment exercise and we needed guidance on the correct procedure under Malaysian law. Cahaya Firm walked us through each step — the notification requirements, the VSS calculations, the communication timeline — and helped us draft the letters and internal documentation. We avoided what could have been a costly series of claims by following a properly structured process. I would not attempt this kind of exercise without proper advisory again.

We are a small technology company that had been using a generic employment contract template for several years. Cahaya Firm reviewed it against our current team structure and the current Employment Act. There were a number of clauses that were either out of date or unenforceable as written. The revised contract gave us a much cleaner foundation. The process took about a week, which worked well for us.

I was dealing with what I believed was constructive dismissal — a very difficult and personal situation. Cahaya Firm took the time to explain my options honestly, including situations where pursuing a claim might not lead to a favourable outcome. That kind of straightforward counsel helped me make an informed decision rather than acting on emotion. I eventually reached a negotiated settlement and found the whole process, though difficult, professionally handled.

Case Highlights
A selection of situations where Cahaya Firm's involvement produced a meaningful difference for the client.
Case Study 01
SME Compliance Overhaul
SITUATION
A retail business with 60 employees had not updated its employment documentation since 2018. Following the 2023 Employment Act amendments, several of its standard terms were inconsistent with current law.
APPROACH
Cahaya Firm conducted a full gap analysis of existing contracts, the employee handbook, and disciplinary procedures. A prioritised list of revisions was agreed with the HR team and a new documentation suite was prepared.
OUTCOME
Full documentation set updated within six weeks. The business subsequently used the new handbook as the basis for a staff communication exercise on the amended statutory entitlements.
Case Study 02
Industrial Court Conciliation
SITUATION
A manufacturing company received an unfair dismissal claim from a former employee following a performance-based termination. The company had documentation but procedural gaps in how the process had been conducted.
APPROACH
Cahaya Firm assessed the strength of the company's position, identified the procedural vulnerabilities, and prepared a conciliation strategy that acknowledged them while presenting the substantive justification for the termination.
OUTCOME
Settled at the DIR conciliation stage. The settlement figure was materially below what an Industrial Court award might have involved had the procedural gaps not been addressed early in the process.
Case Study 03
Executive Contract Restructure
SITUATION
A technology company was bringing on a senior executive and needed a service agreement that clearly reflected performance-based remuneration, IP ownership, and a reasonable post-employment restriction clause.
APPROACH
Cahaya Firm drafted a service agreement that addressed the client's commercial objectives while ensuring the non-compete provisions were reasonable enough to be enforceable under Malaysian law.
OUTCOME
Agreement executed within two weeks. Both parties were satisfied with the clarity of terms, and the employer was confident the IP and restriction provisions were legally sound.
